Terms & Conditions

Identification: For the purpose of this document, the document will be referred to as a confirmation from this point forward. The guest, renter, tenant is referred to as guest from this point forward. Vacation home or condominium shall be referred to as rental property from this point forward. The homeowner will be referred to as property owner from this point forward.

Confirmation of reservation: If you elect to have Florida Dreams Realty of AMI, Inc make the reservation for you the system will automatically send you a confirmation email containing a link to these terms and conditions. Payment of the booking will be acceptance of the terms and conditions.

Payment Terms: Upon booking $500 or $1000 respectively (for rentals for one month or longer) are due whereas $250 are non-refundable. This down payment is part of the total cost of your reservation. For your final payment you have the choice of making your payments by either check, e-check, credit card (+3% convenience fee), or wire transfer (+$16 wire transfer fee). The final balance due must be received 60 days prior to arrival. If any final payment is not received by the due date, guest agrees that the outstanding amount will be charged to the credit card on file with a 3% convenience fee or may result in cancellation of the reservation. Wire transfers require a $16 wire transfer fee. Guest agrees if the wire payment comes in short that the outstanding amount will be charged to their credit card on file. Other administrative fees may apply.

If the reservation is made within 60 days prior to arrival, the full payment is due and payable immediately by credit card. All funds should made payable to Florida Dreams Realty of AMI, Inc.

All charges (except for optional travel insurance) are subject to 12% sales and resort tax.

Check-In: The check-in process begins at 4 p.m. and is not guaranteed. Guests should not expect to take occupancy sooner than times stated. In some cases check-in may be delayed due to circumstances beyond our control. Rate adjustments cannot be made for late check-in or early departure. Driving instructions and access code are provided when the following two conditions are met: a) the rental agreement is signed and b) the booking is paid in full.

Checkout: Checkout will be promptly at 10 a.m. Any guest that fails to check out by 10 a.m. will be assessed a half day’s rent between 10:01 a.m. and 12 p.m.; a full day’s rent will be assessed if guest vacates after 12 p.m.

Loss of Key or Garage Opener: In case renter loses house or any other relevant keys to the house, renter will be assessed with a replacement fee of $40; any lost garage opener will be assessed with a replacement fee of $80.

Cancellation/Refund: Cancellation more than 150 days prior to arrival will receive a deposit refund less a $250 cancellation fee. Cancellation less than 150 days prior to arrival will forfeit all deposit received. Cancellation less than 60 days prior to arrival will forfeit all monies on account. Cancellations must be confirmed in writing. No refund for any reasons, see also “Act of God”.

Act of God: Subject to Bradenton Asset, LLC Cancellation Policy herein, it is expressly agreed that Bradenton Asset, LLC will not be held responsible and will not issue a refund for any reservations that are cancelled, prevented, restricted or interfered with by circumstances beyond its reasonable control, including without limitation, earthquake, fire, flood, Act of God, hurricane, storms, wars, civil or military disturbances, environmental hazards, or any other cause whatsoever beyond the reasonable control of Bradenton Asset, LLC. In the event you attempt to cancel your reservation, arrive late, depart early, or otherwise alter your reservation as a result of any of the foregoing, you will be subject to Bradenton Asset, LLC Cancellation Policy as detailed herein. Travel and Cancellation Insurance can be a solution to help mitigate the risk for some of these issues. Bradenton Asset, LLC recommends you investigate the merits of perhaps purchasing travel insurance to cover the cost of your reservation in case of the foregoing.

Confirmation: Reservations are not considered confirmed until a member of Florida Dreams Realty of AMI, INC management has approved the booking. FLORIDA DREAMS reserves the right to audit, adjust, or cancel any confirmed reservation for inaccuracy or misquoted information at no penalty to Florida Dreams Realty of AMI, INC. Confirmation of rental property can only be established when a deposit is made. All payment and cancellation policies are placed in effect at that time. Once a reservation is confirmed, a rental property will be assigned.

However, no rental property request is guaranteed. Any difference in rate is subject to guest approval.

Occupancy/Maximum Occupants: We do not accept reservations from anyone under 25 years of age. We do not allow persons under 25 to occupy a property unless accompanied by someone over 25 years of age. The maximum number of guests is set by the property owner and/or association and includes small children and infants. The maximum occupancy for your rental property is noted on the confirmation. The rate may vary depending on the number of occupants. Exceeding these limits shall result in forfeiture of payments/deposits and will incur an extra charge per person to the guest. Reservations obtained under false pretences will cause forfeiture of all payments and the guests will be asked to vacate the rental property immediately.

Noise Ordinanace: The island does have a noise ordinance after 10pm, this ordinance pertains to any loud music or loud sounds coming from the property after this hour. If the police or the management company is called due to the renters disturbing the peace we do reserve the right to terminate the rental agreement immediately.

House Parties: Bradenton Asset, LLC does not allow house parties in any rental property. Guests are not allowed to organize graduations, proms, gatherings, reunions, weddings, receptions or any other function similar in nature.

No Smoking: Smoking is permitted outside only. Any guest that smokes inside a rental property will be asked to leave immediately and all charges to restore the rental property back to its original condition will be charged to the guest.

Quiet Use and Enjoyment: Bradenton Asset, LLC does not guarantee quiet use or enjoyment of rental properties due to noise from other persons, neighboring properties, construction, maintenance, etc. Bradenton Asset, LLC cannot grant rate adjustments resulting from circumstances outside of the rental property.

Pets: Pets are not permitted in most rental properties unless specifically authorized. In the event that a rental property does accept a pet, Bradenton Asset, LLC must be notified when making the reservation and a non-refundable pet fee is applied to the reservation. In the event that a guest has a pet in a rental property where it is not allowed, this will cause forfeiture of all payments, the guests will be asked to remove the animal and/or vacate the rental property immediately. The guest will be charged for any costs with regard to returning the rental property to its original condition.

Security Deposit: Renter acknowledges that the damage waiver fee purchased at the time of rental covers damages up to $500. The renter agrees to be responsible for all damages in excess of this sum which will be determined if necessary by arbitration. Renter agrees that in the event of failure to agree by arbitration, proceedings will be held in the Manatee County Court. After your departure the accommodation is checked by Housekeeping. The accommodation must be left in reasonable and clean condition or extra cleaning charges may be imposed. In the event it is found the accommodation incurred careless damage, requires excessive cleaning, or has missing items, the guest acknowledges and agrees their credit card will be debited to replace said items at the fair market price. Customer agrees to pay reasonable attorney fees and all court costs and expenses to enforce this agreement including appellate proceeds with or without legal proceedings.

Units for Sale: In the event that the rental property, which guest is renting, is listed for sale, we may find the need to show the property during a guest’s stay. We will make every attempt to schedule the showing at a convenient time so as not to disturb your vacation. By acceptance of this confirmation guest agrees to allow rental properties to be shown.

Entry of Premises: Guest agrees to allow Bradenton Asset, LLC employees, vendors, contractors or subcontractors access to the rental property for any reason to make repairs, improvements, care for or manage the property.

Agency Disclosure: Florida Dreams Realty of AMI, INC serves as agent and representative of all owners of condominium units and private dwellings in its rental program and is acting at all times in and for the best interest of the owner.

Pest Control: Rental properties are treated for pest control by a contracted pest control company. Bradenton Asset, LLC will make every effort to address pest control concerns, but is not responsible for rebates due to the presence of pests or in the event of untimely service by pest control companies. Anna Maria Island is a tropical island and some pests are inherent to the region and climate making them resilient against professional treatment.

Hurricane Policy: If you are travelling between June and November, please note that this is hurricane season. Owners are not required to rebate rent in the event of a voluntary or mandatory evacuation.

Student Groups: Any guest under 21 years old must be accompanied by a parent and/or guardian. Reservations obtained under false pretenses will cause forfeiture of all payments and guests will be asked to vacate the rental property immediately.

Maid Service/Special Requests: Linens and bath towels are included in each rental property and have been inventoried prior to your arrival. Your rental property is cleaned prior to your arrival and upon your departure, but does not include daily maid service.

Booking Fee: The reservation fee on the face of this confirmation is non-refundable at any time for any reason.

Telephone Charges: There is no charge for local telephone calls. Long distance calling varies. Some properties allow direct long distance dialing while others require long distance calls to be placed on a calling or credit card. Direct dial long distance calls shall be billed to the guest with a handling fee of $20.00.

Entire Agreement: This agreement shall be governed and enforced according to the laws of the State of Florida. The prevailing party in any lawsuit to enforce any provisions of this agreement shall be entitled to an award of attorney’s fees, cost of expenses for mediation, arbitration and trial or appellate proceedings. This agreement contains the entire agreement of the parties. It may not be changed orally, but only by agreement in writing signed by the party against who enforcement of any waiver, change, modification, extension or discharge is sought. Renters cannot assign or transfer this agreement.

Vehicles: Recreational vehicles (RV’s), boats, motor homes, trucks, trailers etc. are not permitted.

Pools and Spas: Homes with private pools are heated during the winter months. The setting is at 82F. For higher setting an additional fee of $100.- per week applies. Please contact Bradenton Asset, LLC to add this optional amenity to your rental contract. No credit, discount and/or rate adjustment can be granted for items mentioned above or circumstances beyond our control.

There will be days when the weather conditions will not allow pool heaters to accommodate swimming, and temperature recovery times will vary. 82F is the highest heat temperature setting. During the winter months pool temperatures will probably stay around 75F. If several cold days occur, water temperatures will drop and may stay cooler longer. Pool heaters will not operate and will automatically shut down if outside temperatures get too cold (below 60F). There will be days when the weather conditions will not allow pool heaters to accommodate swimming and temperature recovery times will vary. While we take every precaution to ensure that pools are heated as specified, weather conditions may affect the temperature of the pool and spa.

Outdoor spas are not hot tubs. Spa temperatures are set at the same temperature as the pool. Guests should not expect hot tub like temperatures for pool spas.

Because there are no lifeguards or other attendants at the swimming pools, guests are expressly responsible for the safety of themselves, members of their families, and guests using swimming facilities or other recreations facilities, and in so using or permitting to be used, specifically waive any and all liability claims, expressed or implied, against the Condominium Association or Home Owner. No guest shall permit any juvenile or non-swimming member of his family or guest to play in or around any swimming facility without providing an attendant who is able to swim and can protect such juvenile in case of difficulty in the water.

Private homes with pools have weekly maintenance carried out by a qualified and licensed pool company. Due to the tropical nature of our Island it is not unusual to find unexpected debris in the pool falling from trees & surrounding vegetation, especially when there is a breeze or rain showers. If you wish to arrange for additional pool service, this can be scheduled with the pool company for a $40 cash payment due from guest at time additional pool service is completed.

Pool heaters in our private homes are locked for your safety and controls must not be tampered with as they are monitored by the pool company.

In the event of pool equipment malfunction during your stay, FDR will expedite repairs as quickly as possible. It may be necessary to close swimming pools for maintenance purposes. No refund or rent adjustment will be made for circumstances beyond our control, malfunctions or loss of use of equipment or amenities.

Radon Gas: Radon Gas is a naturally occurring radioactive gas that, when accumulated in a building in sufficient quantities may present health risks to persons who are exposed to it over time. Levels that exceed Federal and State guidelines have been found in buildings in Florida. Additional information regarding Radon Gas and Radon testing may be obtained from Manatee County Health unit.
